Agreement for Prevention of Infringements
The Agreement on Cooperation for Prevention of the Intellectual Property Rights Infringements (the Agreement) was signed on March 6, 1998 in Moscow.
The Agreement was elaborated by the Ukrainian party (the State Patent Office of Ukraine) within the Interstate Program of joint measures against organized crime and other dangerous types of crimes in the territory of CIS member states for the period up to 2000 and approved by the Resolution of the Council of Heads of Governments of CIS of May 17, 1996.
The Agreement entered into force on January 19, 1999 - from the date of depositing at the depositary – CIS Executive Committee – the third notice of providing necessary domestic procedures by signatory parties.
The Agreement came into force for Ukraine on December 28, 2000 after transferring to the depositary the letters of its ratification by the Verkhovna Rada of Ukraine on September 21, 2000.
The Working Commission of the States Parties to the Agreement was set up under Article 7 thereof to realize effective measures to prevent and suppress infringements in this sphere as well as to coordinate actions of States Parties thereto. The Commission is a standing advisory body. A draft Provision on the Commission was elaborated by the Ukrainian party in pursuance of the Order of the Cabinet of Ministers of Ukraine # 6582/8 of April 13, 1998 and approved by the Resolution of the Council of Heads of Governments of CIS of June 20, 2000.
The Commission’s Rules and Schedule for 2000-2001 were approved at the first organizational meeting of the Commission held on September 14-15, 2000 on the CIS Executive Committee in Minsk , Belarus . Representatives of the State Department of Intellectual Property took an active part in work of six meetings of the Commission.
On the strength of the Decree of the President of Ukraine #85/2002 of January 30, 2002, the Ministry of Education and Science of Ukraine is to coordinate measures of the applicable central administrative authorities on monitoring of laws observance in the intellectual property field. By the Order of the Cabinet of Ministers of Ukraine #Ind.50 of August 26, 2002 about representation in the Commission the Ministry of Education and Science of Ukraine resumed in fact its participation in work of the Ukrainian part of the Commission. By the Order of the Cabinet of Ministers of Ukraine #17700/20 of December 20, 2002 Mr. Valentyn Chebotarev was appointed Plenipotentiary of Ukraine in the Commission while the Order of the Cabinet of Ministers of Ukraine #258-r of May 5, 2003 determined the authorized bodies responsible for the Agreement to be duly fulfilled.
