Department Participation

In June, 2002 the meeting of the Department, Derzhpatent and UACCR management with representatives of the Overseas Trade Department (USA) and USA Embassy in Ukraine was held in the Department. The participating parties discussed the US ability to support Ukraine ’s efforts to accede the World Trade Organization (WTO) in the field of intellectual property protection as well as the opportunities of future cooperation therein.

The successive round of the bilateral talks with the member states of the Working Group for consideration of Ukraine 's WTO membership application and the IX meeting of the Working Group, both held on June 24-26, 2002 , were dealing with the issues of the requirements of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) to be implemented in Ukraine .

The issues concerned with intellectual property rights Ukraine would provide were discussed with the assistance of representatives of the delegations of USA , EU, Canada , Australia , Switzerland , Argentina , Czech Republic , Slovakia , Moldova and other countries having recognized considerable progress in building up the regulatory and legal framework in Ukraine in accordance with international standards, especially with TRIPS requirements.

The fourth joint meeting of the Subcommittee on Trade and Investment of the EU/Ukrainian Committee for Cooperation was held on July 17, 2002 in the Ministry of Economy and European Integration. The sub-committee's agenda included the issues concerning Ukraine ’s WTO membership and likely effects of European Union expansion toward Ukraine , including the trade protection sphere. The member of the Ukrainian side of the Subcommittee Mr. Volodymyr Zharov, First Deputy Chairman of the Department mentioned inter alia that the priority directions of the development of world community-Ukraine relations in the field of intellectual property rights protection were concerned with harmonization of the Ukrainian laws in this field with international standards.

Within WTO technical mission in August, 2002 the WTO Information Centre was opened at the Ministry of Economy and European Integration. The presentation was attended by representatives of the WTO Secretariat, the Project of Ukraine’s Trade Policy Support, some executive authorities within the competence whereof were issues concerned with Ukraine ’s accession to the WTO as well as the Department representative.

On September 24, 2002 the Ministry of Economy and European Integration of Ukraine held the first meeting of the Joint Ukraine-EAFT (European Association for Free Trade) Committee the agenda whereof had included the issues of developing commercial and economic cooperation between EAFT member countries and Ukraine , especially in the field of intellectual property (trade aspects of intellectual property rights). The Department was represented by Mr. Volodymyr Zharov, First Deputy Chairman thereof.

The Twelfth meeting of the Ukrainian side of the EU-Ukraine Cooperation Committee was held in the same place. The focus of attention was one of the items on the agenda concerning increase in remedial effectiveness and tightening control over infringements of intellectual property rights.

On October 16, 2002 at the Verkhovna Rada Committee on Economic Policy, National Economy Management, Property and Investments the joint meeting with the Committee on Industrial Policy and Entrepreneurship and Committee for Agrarian Policy and Land Relations was held. The issue “On Prospects of Ukraine’s Accession to the WTO” was discussed at the meeting. Mr. Volodymyr Zharov, First Deputy Chairman of the Department participated in this discussion.

On October 18 the meeting of coordinators of the EU-Ukraine Cooperation Committee’s Ukrainian side took place in the Department for European Integration at the Ministry of Economy and European Integration of Ukraine and dealt with the matters of cooperation between Ukraine and European Communities. The matter of coordinating a draft Joint report on the implementation of the EU-Ukraine Partnership and Cooperation Agreement was discussed at the assistance of Mrs. Iryna Darmogray, Executive Coordinator, Chief Specialist of the Law Enforcement Section of Industrial Property Division of the Department.

The Department elaborated a draft Law of Ukraine «On Amendment of Certain Legislative Acts of Ukraine on the Legal Protection of Intellectual Property”, whereby the legislation of Ukraine in the intellectual property sphere was harmonized with the requirements of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).

This draft Law was discussed at the meetings of the Verkhovna Rada Committees on Science and Education, on Legislative Support of Law- Enforcement Activity, on Foreign Affairs, on European Integration. The Law was passed on May 22, 2003 .

On November 7, 2002 there was held the meeting of the Government Committee on economic development and European integration issues whereat the Schedule of Measures to Prepare for the Following Round of Negotiations and the Next Meeting of the Working Group for consideration of Ukraine 's WTO membership application was considered. By the results of consideration in the Department a draft Order of the Cabinet Ministers of Ukraine “On Measures to Prepare for the Following Round of Bilateral Negotiations and the Next Meeting of the Working Group for Consideration of Ukraine's WTO Membership Application” was agreed. This Order was signed on November 16, 2002 .

In pursuance of the resolutions of the Tenth enlarged meeting at Chairman of the Ukrainian side of the EU/Ukrainian Committee for Cooperation the Department prepared information materials about implementation of the Partnership and Co-operation Agreement ("PCA") between Ukraine and the European Communities as well as their Member States in the context of intellectual property rights’ protection for the statement of the official delegation of Ukraine at the Fifth meeting of the EU/Ukrainian Committee for Cooperation.
