State Enterprise Intelzakhyst
State Enterprise Intelzakhyst was established in pursuance of the Order of the Ministry of Education and Science No 449 of August 6, 2002. It is based on the state ownership principles, governed by the Ministry of Education and Science of Ukraine and subordinated to the State Department of Intellectual Property of the Ministry of Education and Science of Ukraine (the Department).
The enterprise was set up to improve the procedure of issuing control marks for marking copies of audiovisual works and phonograms as well as reinforce protection of intellectual property rights.
After the Law of Ukraine "On Amendment of the Law of Ukraine "On Distribution of Copies of Audiovisual Works and Phonograms"" of July 10, 2003 No 1098-IV had come into force in August, 2003 the enterprise proceeded also to the issue of control marks for marking copies of videograms, computer software and databases.
Major tasks of the enterprise:

management and maintenance of keeping the Unified Register of Recipients of Control Marks for marking copies of audiovisual works, phonograms, videograms, computer software and databases;

supporting the issue of control marks for marking copies of audiovisual works, phonograms, videograms, computer software and databases;
-
participation in the Department efforts to realize the state policy as to software legalization;
-
giving effect to other measures concerned with protection of intellectual property rights.
When carrying out its activity the enterprise is governed by the Constitution of Ukraine, Laws of Ukraine “On Copyright and Neighboring Rights”, “On Distribution of Copies of Audiovisual Works, Phonograms, Videograms, Computer Software, Databases”, the Decree of the Cabinet of Ministers of Ukraine “On Approval of the Provisions on Distribution of Copies of Audiovisual Works, Phonograms, Videograms, Computer Software, Databases” of October 13, 2000 No 1555, the Order of the Cabinet of Ministers of Ukraine “On Approval of the Conception of Software Legalization and Fight Against Its Illegal Usage” of May 15, 2002 No 247-r as well as other regulatory and legal acts that regulate the field of intellectual property protection, especially regarding copyright and related rights.

Major tasks of the Division:
- acceptance and adequacy examination of copies of audiovisual works and phonograms as well as documents for obtaining control marks being submitted by importers, exporters and reproducers thereof;
- support for the enterprise participation in the Department’s efforts to realize the state policy on protection of intellectual property objects;
- interaction with the Department’s specialists on improving the regulatory and legal framework in the field of intellectual property;
- legal maintenance of the enterprise activities.
Control Marks Issue Division

- keeping by the Department’s order the Unified Register of Recipients of Control Marks and delivery of data therefrom in accordance with the current legislation of Ukraine ;
- drafting the Department’s resolutions on the issue of control marks to applicants;
- receipt, storage and issue of control marks.
Software Legalization Division

Major tasks of the Division:
- assistance to the Department in implementing measures to improve the regulatory and legal framework concerning the issues of software legalization;
- keeping by the Department’s order the Register of Software Producers and Distributors;
- acceptance of documents from the persons applying for entering them in the Register, examination thereof for their conformance to the requirements of suitable regulatory and legal acts as well as providing consultations for such persons.
