The reproduction for personal purposes and under home conditions of works and performances recorded in phonograms, videograms is permitted without consent of an author (authors), performers and manufacturers of phonograms (videograms), but with payment of a remuneration to them.

 

The payment of the mentioned remuneration is made in the form of deductions by the manufacturers and importers of the equipment and material carriers, with which aid it is possible to carry out the reproduction of works and performances recorded in phonograms and (or) videograms under home conditions.

 

The rates of deductions are approved by the Decree of the Cabinet of Ministers of Ukraine of June 27, 2003 No. 992.

The procedure of the mentioned deductions was approved by the joint order of the Ministry of Education and Science of Ukraine, State Committee on Regulatory Policy and Business and State Tax Administration of Ukraine of 24.11.2003 No. 780/123/561 (registered in the Ministry of Justice of Ukraine on 12.12.2003).

 

An organization authorized to collect and distribute among the copyright and related rights subjects the funds from deductions (percentage) made by the manufacturers and importers of the equipment and material carriers, with which aid it is possible to carry out the reproduction of works and performances recorded in phonograms and (or) videograms under home conditions, has been determined Association of Enterprises "Ukrainian Music Alliance".
