Register of Software Manufacturers and/or Distributors

 

To carry out the tasks provided for by the Concept for Legalization of Software and Measures against its Illegal Use, the Cabinet of Ministers of Ukraine approved by its resolution No 247-r of May 15, 2002, the Register of Software Manufacturers and/or Distributors (ukrainian version) was established.

Beginning from March 1, 2003 the Department is charged with keeping the Register and issuing certificates of the standard pattern to economic activity’ subjects being entered therein.

In order to provide collection and systematization of valid data on economic activity subjects which realize manufacture and/or distribution of software products in Ukraine, make arrangements aimed at intellectual property rights’ protection as well as promotion of civilized competitive activity in this field, ensure transparency of the procedures of purchasing goods, works and services for public money as well as to optimize and rationalize the use thereof the Ministry of Education and Science of Ukraine issued the Order No. 8 of January, 2003 "On Establishment of the Register of Software Manufacturers and/or Distributors". There was also approved the "Provision on the Register of Software Manufacturers and/or Distributors" by this Order. To this document were also attached the forms of applications for entry into the Register and certificates of entering economic activity subjects therein.

The first Certificate of entering an economic activity subject into the Register of software manufacturers and/or distributors was issued on March 14, 2003. Mr. Volodymyr Dmytryshyn, Deputy Chairman of the Department presented this document to the famous Ukrainian enterprise - CJSC Kvazar-Micro Techno. Mr. Volodymyr Dmytryshyn, in particular, noted the Register should allow to use effective paths and methods for protection of author (and their successors’) rights concerned with designing and using of computer programs and databases. Such valid information shall provide transparency of the procedures of purchasing goods, works and services for public money and possibility of the rational use thereof. The fact that “Kvazar-Micro” was the company that obtained Certificate No. 1 was not the first case of recognizing its leadership on the information technology market in the course of realization of large-scale government projects and carrying out of nation-wide programs. In turn, Mr. Anatoliy Veres, Business Expansion Director of “Kvazar-Micro” corporation, thanked the Department for recognition of its activity. "Legality, competence and concentration of efforts on leveling up the general standard of Ukrainian society’s information culture – here are three main principles whereby the company is guided when designing and distributing its software products".

Economic activity subjects are entered into the Register on a voluntary basis according to applications received. A Certificate of the standard pattern shall be issued to a subject at its request after the decision of entry into the Register is taken.

To be entered into the Register an applicant should submit personally or send by registered mail a required set of documents to State Enterprise “Intelzakhyst" (34 B. Khmelnytsky Str., Kyiv, 01030, phone 234-22-03). For more details see Information Letter.

Any application for entry into the Register shall be considered within a month after the date of its receipt at State Enterprise “Intelzakhyst”.
